Bankruptcy Settlement Discharge

Property settlement awarded in Divorce, ex now filing for bankruptcy?

In my div. decree, my ex was ordered to assume debt for car loan, but he has never made a payment, I paid it for the last 4years, now I’m going after him for the past payments, but to find out he has now filed for bankruptcy to have it discharged
is there anything I can do…or am I stuck?…by the way he is also behind on child support payments too!!

Yes there is something you can do. You can contact the judge that granted your divorce and request a judgment on him to repay money you have had to pay. and as far as child support being behind you can contact the child support enforcement agent in your county and let them know where he is and if he works, where he is employed. most states will suspend a drivers license for nonpayment of child support and also ask the judge for jail time.

My ex wife accepted all her debt in our divorce. Can an “abstract of judgment” be placed on my home?

My exwife caused an accident in June 2008, a judgement and settlement was filed. However, an “abstract of judgement” has been placed against my homestead. She agreed to all the debt she established while married in the divorce. How does this make me responsible and how do I get her creditors to stop contacting me?

Legally, if there is a court order absolving you of her debt, the creditors can’t come after you for it. They can try, but you fax them a copy of the order and tell them if they contact you again or attempt in any way to collect the debt from them and you will sue them for harrassment, and most creditors will back down.
This is, of course, assuming the judgment was reached after she no longer had any legal right to the property.
As long as her name was removed from the title prior to the judgment and you have the court order assigning the debts to her, you should be fine.

financial settlement for undefended divorce?

An undefended divorce on 10-year marriage with no children.
1) will the court still look at our financial settlement even we are undefending and have reached an agreement?
if so,
2) at which stage of divorce procedure?
3) is there any form regarding to this issue?

4) Am I still have right to pull out/disagree after “decree nisi”? (I am the respondent): as it’s my first time and have no idea how divorce will go on; in case, for a reason I need to negtiate with my s2bx again and want to pull out /disagree the divorce after the “decree nisi” has issued, Can I?

you have six weeks to pull out when you get decree nisi, make sure everything is in writing with your solicitor, people are strange creatures we tend to change our minds and when its money involved more so, even if you are both in agreement always cover yourself. this is your future we are talking about
