
Can a online cash advance company take you to court?
In 2007, I foolishly (I admit it) took out a cash advance loan online. Lately, I have been getting phone calls threatening to start legal proceedings. I did call and try to resolve the issue, but the settlement was more than i can afford, and due to me now being a full time student, I am not able to afford it. Are they allowed to even do this, or is this another creative way a collections company is doing their operations? You sometimes hear about collection agencies that threaten people, and I want to know if this is really a possibility. I have received no notification in the mail, and when the loan was originally taken, a check was not used, which causes me to further question this situation. What do you guys think?
They CAN sue. That said, ANYTHING a collector threatens is a LIE. IF they decide to sue, your FIRST notice will be when you are served with the actual lawsuit. This is NOT another creative way for a collection company to do business. It is not new OR creative.
