Insurance Settlement Whiplash

Should I take this accident settlement? Is it fair?

I was in accident half year ago. Another driver rear-ended my car and he got cited for following too close. I had whiplash injury and felt it the next day. My car was totalled. I got a check from the All State insurance (his) in the amount of whats my car worth ($3000) and rental car ($300) and tow ($100).

The medical bill for 2 months whiplash therapy was about $1500.
I got a lawyer and they are working on settlement and the final offer from the All State is $3500. Minus $1500 on medical and $600 for lawyer, I get net $1400 for the accident.

Should I accept this final offer? Is it fair? If not it will take to the court and we can not predict the outcome.

Your bills are all paid and you have a little left over. You didn’t get busted up too badly, so you don’t get a big windfall. Take it and move on because your lawyer fees will accumulate rapidly if court is involved. This is not the type of injury where you’d get a large settlement.
